Your privacy is important to us. Protecting the privacy and confidentiality of your personal information is very important to our employees and the Firm. We value your business and the trust you place in us.
To offer you the legal services you seek, we collect, maintain, and use information about you on a routine basis. To help you better understand how your personal information is protected at our Firm, we are providing you with this statement which describes our practices and policies concerning the privacy of our clients information. If you terminate your client relationship with us or become an inactive client, we will continue to adhere to the policies and the practices described in this Notice.
Types of Information we collect. In the course of our representation of you, we may collect Non-Public Personal Information about you which you provide or we obtain with your authorization.
Examples of sources from which we collect information:
CLIENT INTERVIEWS, TAX RETURNS, FINANCIAL PLANNING REPORTS, AND FINANCIAL HISTORY QUESTIONNAIRES
To properly represent you, we may receive information from you in written form, by phone, online, by mail and in personal interviews, and from others by interview, interrogatories, depositions, and the like.
TRANSACTION INFORMATION
This is information about your transactions with us and includes information necessary for billing and payment for our representation, and all correspondence between you and us. Transaction information also includes your payment history with us, billing records, and our collection efforts for payment of services rendered for you.
Parties To Whom We Disclose Information. As attorneys, we are governed by attorney-client privilege and confidentiality rules, and thus keep all non-public personal information obtained from our clients or former clients strictly confidential. We do not disclose any such information to our affiliates or to non-affiliated third parties without your prior consent, except as permitted or required by law, as follows:
1. Complying with a validly issued and enforceable subpoena or summons;
2. Initiating, or responding to, a complaint made before an ethics tribunal or duly constituted investigative or disciplinary body (e.g. the Maryland Bar Grievance Commission);
3. Reviewing a professional practice in conjunction with a prospective purchase, sale, or merger of all or part of our practice, provided we take appropriate precautions (e.g. through a written confidentiality agreement) so the prospective purchaser does not disclose information obtained in the course of the review;
4. Participating in actual or threatened legal proceedings or alternative dispute resolution proceedings either initiated by or against us, provided we disclose only the information necessary to file, pursue, or defend against such proceedings, and take reasonable precautions to ensure that the information disclosed does not become a matter of public record;
5. Providing information to affiliates of the Firm and non-affiliated third parties who perform services or functions for us pursuant to the contractual agreement which prohibits the affiliate or third party from disclosing or using the information other than for the purposes for which the information was disclosed: for e.g. using an outside service bureau to process client's tax returns, or, using a records-retention agency to store client's record ;
6. We may also provide information to third parties in connection with our representation (e.g., providing information about a proposed estate plan to your accountants, brokers and/or other financial advisors, responses to discovery in answers to interrogatories and responses to requests for production of documents). We will not disclose such information without your consent and will not disclose any more information than is necessary to complete the proposed transaction.
Confidentiality and Security of Nonpublic Personal Information.
We restrict access to Nonpublic Personal Information about you to those employees
and other parties who may use that information to provide services to you. Their
right to further disclose and use the information is governed by the restrictions
set forth above. We also maintain physical, electronic, and procedural safeguards
in compliance with applicable laws and regulations to guard your Nonpublic Personal
Information.
